1. General legal information

1.1 Background

These Terms and Conditions of Use govern the relationship between

and

The Client - Consumer

1.2. SUBJECT

distance buying and selling relationship by means of the website of the Proponent (https://www.mila.it/) for the purchase of "guided tour" vouchers at the factory in Bolzano (BZ), Via Innsbruck No. 43, better described in art. 4 of these terms of sale.

In accordance with Article 1326 of the Codice Civile, the contract is concluded when the Customer completes the purchase procedure on the Proponent's website, on the homepage, in the "Visits" section, selecting the language of the visit, the desired date and time. After customizing the data of the guided tour, the Customer must add the guided tour voucher to the purchase cart by clicking "Add to Cart", accepting the terms of sale, privacy policy and thus proceeding to payment in a new window, where the mandatory data must be entered in order to proceed and finalize the order. Only after the payment is completed, will the Customer receive the confirmation of successful booking to their email address indicated in the order procedure.

1.3 The Customer, by the Order Confirmation, unconditionally accepts and undertakes to observe, in its dealings with the Proponent, the provisions contained in these Terms and Conditions of Use.

2. Obligations of the Parties

With the completion of the contract, the Customer:

  • is obligated to pay for the "guided tour" voucher at the price displayed on the site, subject to selection in the order process of the number of participants in the tour and day and time of preference;
  • is obligated to report in the appropriate spaces provided in the order procedure all the information necessary for Latte Montagna Alto Adige to organize and manage guided tours in the best possible way, in particular the presence of minors or persons with disabilities directly or indirectly functional to the execution of the service;
  • is obligated to show up on the day and time set for the guided tour at the factory in Bolzano (BZ), Via Innsbruck No. 43 at least 15 minutes in advance of the time booked and confirmed by Latte

Montagna Alto Adige.Latte Montagna Alto Adige is committed to:

  • Give prompt confirmation to the Customer of the details of the concluded order, particularly with reference to the day and time chosen for the guided tour;
  • is obligated to promptly identify and communicate an alternative date and time with fixation within 60 days of the date and time booked and paid for by the Client, where unforeseen circumstances not attributable to the parties arise, that make it impossible to use the guided tour voucher for the day and time booked by the Client.

3. Applicable law and forum for disputes

Purchases made on the Proponent's website are regulated, as far as not expressly provided for in these conditions by the Codice Civile, dal D.lgs. 205/05 (cd “Codice del Consumo”), dal D.Lgs. 185/99 (“Attuazione della direttiva 97/7/CE relativa alla protezione dei consumatori in materia di contratti a distanza”), as well as EU Reg. 679/16 and Legislative Decree 196/2003.

For the purpose of dispute resolution for this contract, the judicial authority of the Customer's place of residence shall have jurisdiction.

4. Information on products, availability and prices

4.1. Nature of products

Guided tour voucher at the factory in Bolzano (BZ), Via Innsbruck No. 43: The guided tour lasts 2 hours and is conducted in groups with no minimum limit of components, but a maximum of 50 components.

For safety and hygiene reasons, the guided tour will be held in virtual mode as far as it pertains to the production factory; it will take place in physical presence in the part of the offices and the store-bistro open to the public.

The Proponent takes care that the information regarding the characteristics of the marketed products and services is regularly updated and available on their website, as to supply the most correct information to the Customer.

4.1 Availability of vouchers

The availability of the vouchers that can be purchased on the site is managed by means of computer tools, and is subject to a margin of error: in any case, the Proponent does not guarantee the availability of the reservation on the day and time chosen by the Customer at the time of the Conclusion of the Order, as there is a subsequent phase of verification of the reservation by the Proponent, which confirms the date and time chosen by the Customer or identifies another date in the terms set forth in Article 2 above.

In the case of overbooking with respect to a reservation slot, the Marketing Department will contact the Customer in a timely manner, guaranteeing a choice between a replacement voucher to be spent within 9 months from the date of the order or a refund of the amount paid and not used.

4.2. Pricing

The prices charged for visits to the Proponent, excluding VAT and per group, are as follows:

  • 1-10 people: € 49.00
  • 11-15 people: € 91.00
  • 16-20 people: € 126.00
  • 21-25 people: € 161.00
  • 26-30 people: € 196.00
  • 31-35 people: € 231.00
  • 36-40 people: € 266.00
  • 41-45 people: € 301.00
  • 46-50 people: € 336.00

The Proponent has the right to reserve promotions and discounts for tour participants on the sale of products at the Mila store attached to the production factory in Bolzano (BZ), with discounts from 10% to 30%, usable only on the day of the tour itself.

5. Methods of Payment

The guided tour vouchers must be paid for by the Client with one of the following methods, to be selected from the payment methods supported by the online operator Mollie (platform to which the order will be redirected for the payment stage):

  • Credit Card (VISA, Mastercard, Maestro)
  • Apple Pay, with automatic forwarding to the relevant payment processing services and acceptance of the relevant contract terms and conditions
  • PayPal, with automatic forwarding to the relevant payment processing services and acceptance of the relevant terms and conditions.
  • Google Pay, with automatic forwarding to the relevant payment management services and acceptance of the relevant terms and conditions.

In the case of payments made electronically, the Proponent may have access to the linked transaction in order to conduct audits, for ordinary accounting operations, handle disputes and issue any refunds.

6. Mode of Delivery

6.1. The guided tour voucher purchased in the manner set forth in the preceding articles is delivered to the Customer virtually, to the email address provided by the Customer at the time of ordering. The Proponent disclaims any liability associated with the failure to timely deliver the guided tour voucher to the Customer, caused by the Customer's incorrect or failure to provide their respective email address.

6.2 Delivery of the virtual guided tour voucher by email is free of charge.

6.3 Where the Client wishes to obtain the guided tour voucher in paper format, the Client shall make a special email request to the Proponent, who will proceed to send it in paper format to the address provided by the Client.6.4 All shipping costs for the guided tour voucher in analogue format will be borne by the requesting Client.

6.5 Average delivery time: 1-2 business days (Continental Italy excluding South Italy and Islands), 3-4 w business days (South Italy and Islands), up to 7 business days (other locations), always starting from the time the goods are delivered to the courier.

7. Right of withdrawal

Pursuant to Legislative Decree 206/05, in the case of purchase with a distance contract, the Customer may withdraw from the contract with the Proponent without the need for justification and without penalty within 14 clear days from the day of placing the order on the website https://www.mila.it/, with the exception of the purchase of Guided tour voucher with reservation fixed and confirmed within the legal deadline for the exercise of the right of withdrawal: in such cases, the finalization of the purchase and reservation of the guided tour within the 14 days provided for the right of withdrawal shall presume the renunciation, by the Customer, to the exercise of the same.

Notice of withdrawal must be received by return receipt to the Proposer's registered office or by PEC/mail to the following addresses: direzione_at_pec.mila.it

The refund following the exercise of withdrawal will be made without undue delay and in any case within the period of 14 working days from the day on which the Proponent becomes aware of it, by the same method of payment used by the consumer, unless the consumer has expressly agreed otherwise, and provided that the consumer does not incur any costs as a consequence of the refund.

As of the fifteenth day free from the reservation and payment of the guided tour, it will be considered confirmed and cannot be subject to the right of withdrawal.

8. Termination of the contract - conditions of reimbursement

In the case of booking the guided tour beyond the 14-day period provided for the right of withdrawal, the Client shall have the right to terminate this contract, with refund of the price paid, only on the condition that he/she notifies Latte Montagna Alto Adige in writing within 7 clear days from the date fixed and confirmed for the guided tour.

In no other case will the Client be entitled to a refund of the price paid for the purchase of the Guided tour voucher.

At the discretion of Latte Montagna Alto Adige, in the event of proven inability of the Client to attend the booked and confirmed visit, an alternative date within the calendar year may be offered as the only alternative for use of the purchased Voucher

9. Conditions of use of the Site

The Proponent's Site is for personal use only. Making use of the Site for purposes that are illegitimate or harmful to Proposer or third parties is prohibited. This assessment is at the sole discretion of the Proponent, and always includes - among other things - any unauthorized use of a commercial nature.

This provision is to be considered extended to any content on the Site, thereby prohibiting any transmission, distribution or use of it that differs from what is explicitly permitted by these Terms or by applicable Laws.

10. Personal account

A user who intends to transact business with Proposer agrees to provide Proposer with true, accurate, current and complete information about himself/herself as required by the site's registration procedures and the Act.

The user declares and guarantees full ownership and availability of the data, information and content provided during registration/login on the Site. He/she further represents and warrants that their use by the Proponent, for lawful reasons set forth in these Terms, is not such as to violate any rights of third parties, nor is it contrary to any laws and/or regulations.

You agree not to employ others' identities for the purpose of entering into any contract with, or for any interaction with, the Proposer, thereby explicitly providing for the impermissible use of others' accounts or identities.

You further agree to give prompt notification to Proponent in the face of any unauthorized use of your account, as well as for any other breach of security of which you become aware and which affects the Site or aspects related to it.
